General Terms and Conditions for ANOUK Tierbestattung e.C.

Contractual basis:

ANOUK concludes contracts and provides services exclusively on the basis of the written offers prepared by ANOUK and the respectively valid version of any descriptions of services included in the offer, price lists and these General Terms and Conditions. The aforementioned documents shall apply to all legal relationships between ANOUK and the Customer and shall form the basis for all further contracts concluded.

Future changes:

Changes to the descriptions of services, price lists and General Terms and Conditions of ANOUK shall be notified to the Customer in writing and shall be deemed agreed unless objected to within a period of four weeks (for consumers) or two weeks (for entrepreneurs). The amendments shall also apply to all current contracts.

Additional agreements:

All additional agreements, before and during the term of the contract, must be in writing in order to be valid, including a deviation from the written form requirement for entrepreneurs.

Components of the contract on the part of the customer: Specifications of the customer shall only become part of the contract if integrated into the offer or expressly accepted by ANOUK. Legal formative elements of the Customer shall only become effective if expressly accepted by ANOUK.

Procedure in the event of contradictions:

In the event of contradictions between contractual elements of ANOUK and contractual elements of the Customer, the contractual elements of ANOUK shall take precedence.

Conclusion of contract: Offers by ANOUK are subject to change and non-binding. The contract shall only be concluded upon acceptance of the order by ANOUK.

Scope of services, order processing and the Principal's duty to co-operate:

The scope of services is set out in ANOUK's written service description. The customer has obligations to co-operate in order to make the services possible.

Remuneration:

Prices are ex ANOUK's registered office and may be adjusted annually. Payment by instalments is possible.

Liability:

ANOUK's liability is limited and claims for damages are excluded, except in cases of gross negligence or intent.

Online dispute resolution:

An online dispute resolution platform for consumers is available.

Final provisions: The legal relationship shall be governed exclusively by Austrian law, with the exception of mandatory consumer protection regulations of the consumer's home country. The place of jurisdiction for disputes with entrepreneurs is the competent local court in Fürth.
